Required Elements

  • The defendant, with intent to inflict great bodily harm:
  • Assaulted another with a firearm or any deadly weapon or by any force or means likely to produce great bodily harm or death; OR
  • Administered, exposed, or transmitted to or caused to be taken by another, poison, HIV, or any other destructive or noxious substance; OR
  • Assaulted another and inflicted great bodily harm.

Probable Cause Checklist

  • Evidence of intent to inflict great bodily harm.
  • Use of a firearm or deadly weapon.
  • Force used was likely to produce great bodily harm or death.
  • Actual infliction of great bodily harm.
  • Victim and witness statements.
  • Medical records documenting injuries.
