Required Elements
- The defendant, with intent to inflict great bodily harm:
- Assaulted another with a firearm or any deadly weapon or by any force or means likely to produce great bodily harm or death; OR
- Administered, exposed, or transmitted to or caused to be taken by another, poison, HIV, or any other destructive or noxious substance; OR
- Assaulted another and inflicted great bodily harm.
Probable Cause Checklist
- Evidence of intent to inflict great bodily harm.
- Use of a firearm or deadly weapon.
- Force used was likely to produce great bodily harm or death.
- Actual infliction of great bodily harm.
- Victim and witness statements.
- Medical records documenting injuries.
