Required Elements
- The defendant assaulted another person;
- The assault did not amount to Assault in the 1st, 2nd, or 3rd degree.
Probable Cause Checklist
- An unwanted touching that is harmful or offensive.
- An act done with intent to cause fear and apprehension of injury.
- An act done with intent to inflict bodily injury.
- Victim/witness statements.
- Visible signs of injury (redness, scratches, etc.), if any.
- If DV-related, determine relationship and if it occurred within the last 4 hours for mandatory arrest purposes.
