Required Elements

The defendant assaulted another person;
The assault did not amount to Assault in the 1st, 2nd, or 3rd degree.

Probable Cause Checklist

An unwanted touching that is harmful or offensive.
An act done with intent to cause fear and apprehension of injury.
An act done with intent to inflict bodily injury.
Victim/witness statements.
Visible signs of injury (redness, scratches, etc.), if any.
If DV-related, determine relationship and if it occurred within the last 4 hours for mandatory arrest purposes.
