Required Elements

  • The defendant assaulted another person;
  • The assault did not amount to Assault in the 1st, 2nd, or 3rd degree.

Probable Cause Checklist

  • An unwanted touching that is harmful or offensive.
  • An act done with intent to cause fear and apprehension of injury.
  • An act done with intent to inflict bodily injury.
  • Victim/witness statements.
  • Visible signs of injury (redness, scratches, etc.), if any.
  • If DV-related, determine relationship and if it occurred within the last 4 hours for mandatory arrest purposes.
