Required Elements

  • The defendant unlawfully took personal property from the person of another, or in their presence, against their will;
  • By the use or threatened use of immediate force, violence, or fear of injury;
  • AND, in the commission of the robbery or in immediate flight therefrom, the defendant:
  • Was armed with a deadly weapon; OR
  • Displayed what appeared to be a firearm or other deadly weapon; OR
  • Inflicted bodily injury.

Probable Cause Checklist

  • Evidence of a taking of property.
  • Victim statement about force or fear.
  • Weapon was used, displayed, or implied.
  • Injuries were inflicted on the victim.
  • Surveillance footage.
  • Witness statements.
