Essential facts to establish probable cause.
Required Elements
- The defendant unlawfully took personal property from the person of another, or in their presence, against their will;
- By the use or threatened use of immediate force, violence, or fear of injury;
- AND, in the commission of the robbery or in immediate flight therefrom, the defendant:
- Was armed with a deadly weapon; OR
- Displayed what appeared to be a firearm or other deadly weapon; OR
- Inflicted bodily injury.
Probable Cause Checklist
- Evidence of a taking of property.
- Victim statement about force or fear.
- Weapon was used, displayed, or implied.
- Injuries were inflicted on the victim.
- Surveillance footage.
- Witness statements.
