Essential facts to establish probable cause.

Required Elements

The defendant unlawfully took personal property from the person of another, or in their presence, against their will;
By the use or threatened use of immediate force, violence, or fear of injury;
AND, in the commission of the robbery or in immediate flight therefrom, the defendant:
Was armed with a deadly weapon; OR
Displayed what appeared to be a firearm or other deadly weapon; OR
Inflicted bodily injury.

Probable Cause Checklist

Evidence of a taking of property.
Victim statement about force or fear.
Weapon was used, displayed, or implied.
Injuries were inflicted on the victim.
Surveillance footage.
Witness statements.
