Required Elements

The defendant unlawfully took personal property from the person of another, or in their presence, against their will;
By the use or threatened use of immediate force, violence, or fear of injury;
Under circumstances not amounting to Robbery in the First Degree.

Probable Cause Checklist

Evidence of a taking of property.
Victim statement about force or fear (e.g., a "strong-arm" robbery).
No weapon was used or displayed.
No bodily injury was inflicted (beyond minimal force).
Surveillance footage.
Witness statements.
