Required Elements

  • The defendant unlawfully took personal property from the person of another, or in their presence, against their will;
  • By the use or threatened use of immediate force, violence, or fear of injury;
  • Under circumstances not amounting to Robbery in the First Degree.

Probable Cause Checklist

  • Evidence of a taking of property.
  • Victim statement about force or fear (e.g., a "strong-arm" robbery).
  • No weapon was used or displayed.
  • No bodily injury was inflicted (beyond minimal force).
  • Surveillance footage.
  • Witness statements.
