Required Elements
- The defendant unlawfully took personal property from the person of another, or in their presence, against their will;
- By the use or threatened use of immediate force, violence, or fear of injury;
- Under circumstances not amounting to Robbery in the First Degree.
Probable Cause Checklist
- Evidence of a taking of property.
- Victim statement about force or fear (e.g., a "strong-arm" robbery).
- No weapon was used or displayed.
- No bodily injury was inflicted (beyond minimal force).
- Surveillance footage.
- Witness statements.
