Required Elements
- The defendant wrongfully obtained or exerted unauthorized control over the property or services of another;
- With intent to deprive the other of such property or services;
- And the value of the property or services exceeds five thousand dollars (excluding firearms and motor vehicles).
Probable Cause Checklist
- Identify the property or service stolen.
- Establish ownership of the property.
- Establish the fair market value of the property (receipts, appraisals, victim statement).
- Evidence showing the suspect took or possessed the property (surveillance, witness statements, pawn records).
- Evidence of intent to deprive (concealment, false statements, leaving without paying).
