Required Elements

  • The defendant wrongfully obtained or exerted unauthorized control over the property or services of another;
  • With intent to deprive the other of such property or services;
  • And the value of the property or services exceeds five thousand dollars (excluding firearms and motor vehicles).

Probable Cause Checklist

  • Identify the property or service stolen.
  • Establish ownership of the property.
  • Establish the fair market value of the property (receipts, appraisals, victim statement).
  • Evidence showing the suspect took or possessed the property (surveillance, witness statements, pawn records).
  • Evidence of intent to deprive (concealment, false statements, leaving without paying).
