Required Elements
- The defendant wrongfully obtained or exerted unauthorized control over the property or services of another;
- With intent to deprive the other of such property or services;
- And the value is more than seven hundred fifty dollars but not more than five thousand dollars.
Probable Cause Checklist
- Identify the property or service stolen.
- Establish ownership of the property.
- Establish the fair market value of the property (receipts, appraisals).
- Evidence showing the suspect took or possessed the property.
- Evidence of intent to deprive.
