Required Elements

  • The defendant wrongfully obtained or exerted unauthorized control over the property or services of another;
  • With intent to deprive the other of such property or services;
  • And the value is more than seven hundred fifty dollars but not more than five thousand dollars.

Probable Cause Checklist

  • Identify the property or service stolen.
  • Establish ownership of the property.
  • Establish the fair market value of the property (receipts, appraisals).
  • Evidence showing the suspect took or possessed the property.
  • Evidence of intent to deprive.
