Required Elements
- The defendant wrongfully obtained or exerted unauthorized control over the property or services of another;
- With intent to deprive the other of such property or services;
- And the value does not exceed seven hundred fifty dollars.
Probable Cause Checklist
- Identify the property or service stolen.
- Establish ownership.
- Establish fair market value is $750 or less.
- Evidence of taking/possession.
- Evidence of intent (e.g., concealment in a shoplifting case).
