Required Elements

  • The defendant wrongfully obtained or exerted unauthorized control over the property or services of another;
  • With intent to deprive the other of such property or services;
  • And the value does not exceed seven hundred fifty dollars.

Probable Cause Checklist

  • Identify the property or service stolen.
  • Establish ownership.
  • Establish fair market value is $750 or less.
  • Evidence of taking/possession.
  • Evidence of intent (e.g., concealment in a shoplifting case).
