Homicide or the use of deadly force is justifiable when committed by a public officer, peace officer, or person acting under an officer's command and in his or her aid in any of the following cases: (1) When necessarily used in arresting a person who has committed a felony and is fleeing from justice; (2) When necessarily used in preventing an escape from a penal institution; (3) When necessarily used in retaking a person who has committed a felony and who has escaped or has been rescued; (4) When necessarily used in arresting a person for committing a felony in the officer's presence; (5) When necessarily used in suppressing a riot.Visit Website
